I have a Windows 8 OEM disk that came with my PC. A the moment, I have Windows 7 installed [for various reasons]. Do I have to install Windows 8 first before Microsoft will allow me my "free" upgrade?

No, as long as your Windows 7 system is up to date you can upgrade from there.
