Toshiba satellite L635 s3030 touchpad freezes

Cold or warmed up, Synaptics touchpad becomes unresponsive randomly. I have tried uninstalling and reinstalling drivers, no change.
have tried older drivers from working older satellite 11.xx as compared to current driver version (15.xx ) no change in behavior.
laptop is only a couple of months old and has had this problem from the start.

I am thinking that this is a hardware issue, since I have tried the different drivers with no success.

P.S. when it freezes , it can last from a second to several seconds, 10 secs and sometimes longer, purely random.

It is still under warranty , I just want some idea , if possible, if this a known problem and the cause.
