Right, i was downloading Gamespy Arcade and i decided to cancel the download but what happened was the shortcut to the download was created and the data was being pumped into it (so to speak) so i canceled it but when i try and delete the shortcut it will not let me, it says its being used by anohter person or program so please help me get rid of it!

Try deleting it in Safe Mode.
