Can We Waterboard a Virus Maker??

Greetings. I know enough to get into trouble and write code for part of my living (in the A/V world). Pretty technical fella with a background in corporate data security, but my knowledge has been outrun by the newer threats and so I seek assistance. I am still reading posts, getting familiar with the forum. I will post my problem after I have exhausted all knowledge.
If we can't waterboard a terrorist, how about a hacker or virus / malware maker...PLEASE? PLEASE PLEASE PLEASE....
