CD/DVDW Wackiness! Help!

The drive only opens after I press it a bunch of times, there is no set number of presses, and the drive reacts differently (different noises). It feels like I am trying to catch it in-between processes or cycles or something, like some weird timing thing.
It is a
TSSTCORP CD/DVDW TS-H552L

What happens when you right click on the drive in My Computer and select "Eject"?
My browser caused a flood of traffic, sio my IP address was banned. Hope to fix it soon. Will get back to posting as soon as Im able.

It whines and clicks back and forth every couple of seconds...

The thing is, once it is open, it works just fine....

When you right click the drive and select eject...does the drive open right away?

no it does not, it is as if i just pushed the button normally.

I would guess that it's defective hardware..
