Got Trojan, Reformated, Trojan Still Here?

yesterday, i did my nightly scan and it says i had 2 trojans found.
I didn't install anything new to my pc all i had was foobar2000, sp2 , and opera..

I formated this morning my first step was installing service pack 1 updates so i can get sp2...
I installed Kaspersky and opera while doing that, while updating i got this notice

the verison of kaspersky isn't retail could itself be infected. or what else could it be?

It would seem to be a false positive.
