Partitioning the drive will inevitably destroy most of the data on it. The process for installing Vista on top of XP usually includes a window asking if you want to move your files to the new operating system, and will then ask you to save the files on a CD or USB drive. My guess is that some security program blocked the install program from modifying the partitions. What did the error message say?

I assume that you want to do a dual boot of Vista and XP...
I have used a great program to chop my only existing partition into 2.
"Partition Magic"
~With this program you can take free space from your existing partition and make another and then format it.
Worked great for me and my 80 gig.
PS: The trial version only lets you see the functionality. it does not do any type of actual partitioning.

It depends on how you partition it. Vista will write to the drive that you specify - but will also add to the boot sector. So, you may end up having to repair the boot sector if you remove Vista.
I've installed Vista on a 2 hard drive system and it didn't hurt anything - I can still use XP whenever I want to. I installed it on a 2 hard drive system and it broke my XP install (which was to be expected since you can't have 2 Windows directories on the same drive).
As for "cracking" the program - I'd have to advise against that (and it's probably illegal - which isn't condoned here). It's much simpler and easier to use a disk partitioning program to make the partitions before you install Vista.

This specific subject was discussed during my recent trip to Microsoft and we were told that it was a violation of both the EULA and the Beta agreement.

Bellevue, Washington. About 20 minutes from the Seattle airport. A great place to work from what I saw.
The "official" reason for my visit was "to provide technical information for the Windows Certification program".
There's many ways to create a partition. The easiest is to use Partition Magic (a pay-for program). It'll allow you to resize your current hard disk into different programs. There are freeware tools that let you do this - but I'm not familiar with them.
Basically what you do is take the free space on the drive (assuming it's partitioned into just one partition) and un-allocate the space from that partition. Then you make the unallocated space into a partition and format it.

Is it safe to just partition with the XP setup CD?

Basically, there's 2 ways to partition a disk:
1) Using a utility such as Fdisk to partition an empty hard drive
2) Using tools like Partition Magic to partition a hard drive with data on it.
I don't think that the XP disk can do it just by inserting the disk and turning the system on. Check this article out for more details: http://www.pcworld.com/article/id,73826-page,1/article.html
