"CAUTION: Do not block, push objects into, or allow dust to accumulate in the air vents. Do not store your computer in a low-airflow environment, such as a closed briefcase, while it is running. Restricting the airflow can damage the computer or cause a fire.

air vent — The computer uses fans to create airflow through the vents, which prevents the computer from overheating."

but i guess we knew all that

maybe fan is not turning up the way it did when it was new

i've done a little more searching and there seems to be overheating issues with some Dell laptops. notably some Insipron models , even a class action suit, but no much on the vostro. most people with this problem say using a cooling pad with fans has worked for them.

No I don't think it's the fan because it turns up really fast at times I think the heat sync may be dead and the processor needs new paste

If you have removed the heat sink then the old paste should be cleaned off and new applied. IMO, this should be done anytime the heat sink is removed.

You stated that it was infected. Might it still be?

If you bring up Task Manager how many processes are running?

What OS is it running?

yes i know im in the process of getting some heat paste and i don't think it is infected i have scanned it with spybot search and destroy and malwarebytes and avg and microsofts new anti virus software and it is running Windows XP.

Right click on the task bar chose Task Manager. Make sure Show processes from all users is checked. How many processes does it show running?

Why don't you get an effective laptop cooler/cooling pad?
Something from Zalman, Antec or Belkin?

For some reason now the laptop no longer overheats and i can do a full benchmark test on it no problem!

It would still be a good idea to get a laptop cooler, more so if you work long hours on it.
